REFUND POLICY
Terms and conditions for the use of the website epicaaudio.com
GENERAL PROVISIONS
You, or your Designated Entity (together, "Customer") are considering acquiring (or a have acquired) a license (the "License") to certain ÉPICA AUDIO Software Products from www.epicaaudio.com under an End User License Agreement with ÉPICA AUDIO ( the LAEA). By accepting the LAEA you are agreeing to (among other things) the terms and conditions set forth in this Cancellation Policy (the "Policy") below. Capitalized words that are not defined herein shall have the meanings given in the LAEA.
- Terms That Apply When The Customer Acquires Its License From ÉPICA AUDIO. ÉPICA AUDIO distributes its ÉPICA AUDIO Software Products to end users both directly and through third party distributors and dealers. When the Customer acquires its License directly from ÉPICA AUDIO, the following terms apply: a. No Refunds, Except As Required By Applicable Law. If the terms of the License require Customer to pay ÉPICA AUDIO a fee in exchange for the License, as is the case with the Basic Commercial licenses that ÉPICA AUDIO currently offers, Perpetual Licenses, Customer will be required to pay such fee (the "Fee"), as well as any taxes or transaction costs that may apply (the "Transaction Costs" and together with the Fee, the "Required Payment"). All Required Payments shall be made using a payment method that is acceptable to ÉPICA AUDIO, in its sole discretion ("Acceptable Payment Method"). Payments are non-refundable, except as expressly required by applicable law. If the Customer is uncertain as to what law applies or what the Customer's rights are under applicable law, the Customer should consult an expert or relevant governmental authority before acquiring the License for advice on the matter.
- Terms That Apply When the Customer Acquires Its License From a Third Party. When the Customer acquires its License from a third party, the financial terms of that transaction are solely between the Customer and that third party, except as required by applicable law. This means, among other things, that the third party will be solely responsible for:
- a. processing fees, taxes and other transaction costs
- b. processing any recission or refund requests and
- c. processing renewals, except as required by applicable law. Customers shall look solely to the applicable third party with respect to such matters, except as required by applicable law. If the Customer is uncertain as to what law applies or what the Customer's rights are under applicable law, the Customer should consult an expert or relevant governmental authority before acquiring the License for advice on those matters.
- Changes to Terms of the Policy. ÉPICA AUDIO may, from time to time, change the terms of this Policy, in its sole discretion. In such an event, ÉPICA AUDIO shall post the new Policy on www.epicaaudio.com and the new Policy shall be effective immediately upon such posting. Last updated: December 07, 2023
